Terms of Service
The agreement between you and Nova Digital Systems LLP for using CallDear.
Not an emergency or medical service
CallDear is a companionship service. Do not rely on it to get help in an emergency. In an emergency, call 911.
1. About these terms
These Terms of Service are an agreement between you and Nova Digital Systems LLP (“CallDear”, “we”, “us”) for the CallDear calls, the family web app and this website. Nova Digital Systems LLP is a limited liability partnership registered in England and Wales under number OC460186; registered office: Stoney Works, 8 Stoney Lane, London SE19 3BD, United Kingdom. In these terms, “you” means the person who opens a family account and the family members they invite. By creating a family account or using the family web app, you agree to these terms, to the Calling & Consent Policy and to the Privacy Policy. If you do not agree, please do not use the service.
The person who receives the calls is not bound by these terms. Their consent, and how they can stop the calls, are covered by the Calling & Consent Policy.
2. The service
CallDear is an AI voice assistant that calls an older family member on a schedule the family sets, talks with them, remembers earlier conversations, and gives the family a short summary of each call.
CallDear is in early access, and we are not onboarding families yet. When we do, features may change, and the service may sometimes be unavailable.
3. Not an emergency or medical service
CallDear is not an emergency service, a medical service or a medical device, and it is not a substitute for professional care or supervision. The assistant does not diagnose, give medical advice or change any treatment. It can mishear, a call can fail to connect, the assistant may not notice that something is wrong, and an alert may arrive late or not at all. If something suggests a person may be in danger, the assistant tells them to get help and lets the family know, but it cannot call for help itself.
Do not rely on CallDear to get help in an emergency. In an emergency, call 911.
4. Family accounts
You must be at least 18 years old to open a family account. Give us accurate information and keep it up to date. You are responsible for the family members you invite and for keeping your sign-in links private.
5. Adding a person
When you add a person to receive calls, you confirm that:
- they are a member of your family, and you are entitled to give us their name, phone number and the other details you provide;
- the phone number is theirs;
- you will tell them in advance that the assistant is going to call and ask for their consent;
- the information you give us about them is accurate.
If you act for someone as a legal guardian or under a power of attorney, contact us before adding them.
6. Consent comes from the person called
We call a person regularly only after they have answered the consent question in their own words in the consent call described in the Calling & Consent Policy, and you have confirmed that their answer was a yes. Your confirmation tells us what they said; you cannot answer for them or give consent in their place. Confirm a yes only if they clearly agreed. If you are not sure what they meant, ask the question again: no regular calls start until you confirm a yes.
7. Stopping calls
The person who receives the calls may stop them at any time, and we will honor that even if you would like the calls to continue. You can pause the calls at any time. We may also pause or stop calls if we believe consent is missing or unclear, or if the calls seem to cause the person distress.
You can change or turn off how you receive alerts, including automated alert calls and text messages, in the family app. You can also stop text messages by replying STOP, or get help by replying HELP. Message and data rates may apply. Details are in the Calling & Consent Policy.
8. Acceptable use
You agree not to:
- add anyone who is not a member of your family, or anyone who has not been told about the calls;
- use CallDear for marketing, sales, debt collection, secret surveillance, harassment or anything unlawful;
- ask the assistant to obtain money, financial details or passwords from anyone;
- ask the assistant to pretend to be a human being or a particular real person;
- try to access another family’s information, interfere with the service, or copy or reverse engineer it.
9. The assistant is a computer program
The assistant is AI software with a computer-generated voice, and it tells the older person it calls that it is a program at the start of every call. Summaries, memory notes and alerts are produced automatically from what was said in a call and can contain mistakes. Check anything important with your relative directly.
10. Fees
We do not charge anything during early access. Before we charge for anything, we will show you the price and ask you to agree to it. Nothing is charged without your agreement.
11. Suspension and closing an account
You can stop using CallDear at any time and ask us to close your account and delete its information, as described in the Privacy Policy. We may suspend or close an account if these terms are broken, or if that is needed to protect a person or the service.
12. Disclaimers
To the extent the law allows, the service is provided “as is” and “as available”, without warranties of any kind, including fitness for a particular purpose. We do not promise that every call will take place at a particular time or connect, or that the assistant will recognize every concern.
13. Limitation of liability
To the extent the law allows, Nova Digital Systems LLP is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data or profits. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim and US$50. Some places do not allow these limits, so they may not apply to you.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that the law does not allow us to exclude or limit. Nothing in these terms affects your rights as a consumer under the law.
14. Governing law and disputes
These terms are governed by the law of England and Wales. The courts of England and Wales have jurisdiction over any dispute about these terms or the service.
If you are a consumer, this does not take away the protection you have under the mandatory laws of the country or state where you live, and you can also bring a claim in the courts where you live.
If you have a problem with the service, please tell us first at support@calldear.com, and we will try to put it right.
15. Changes and contact
We may update these terms. We post changes on this page with a new effective date and tell family account holders by email before a material change takes effect. If you keep using the service after that, the new terms apply.
